Анотація (abstract)
Drawing from the jurisprudence of the European Court of Human Rights, the study clarifies a state’s positive obligations in contexts of armed conflict and partial territorial loss. It affirms that International Human Rights Law continues to protect conflict-affected populations, based on non-derogable treaty clauses. States are obligated to minimize harm in military operations, account for forcibly disappeared persons, and uphold rights of internally displaced individuals. Even when facing territorial loss, states retain limited jurisdiction as per Article 1 of the Convention, and must use all feasible means to regain control, in line with international law. The scope of these obligations is balanced against available resources and the principle of proportionality.
