Анотація (abstract)
The European Convention onuman ights (EC) underpins the commitment of its member states to the rule of law and the protection of human rights. A cornerstone of this instrument is Article 11, which guarantees the freedom of assembly and association. his article undertakes a rigorous exploration of the European Court ofuman ights’ (EC) interpretation and application of this foundational right. As the custodian of the EC, the Court’s jurisprudence plays a pivotal role in defining the contours of the right to assembly, setting both its inherent limits and its expansive possibilities. Through a detailed examination of seminal judgments, the article traces the nuanced balance that the Court has sought to maintain between safeguarding the democratic underpinning of the right to assembly and addressing legitimate state concerns related to public order, national security, and the protection of the rights and freedoms of others. By dissecting these judgments, this study elucidates the principles and criteria employed by the Court and unravels the broader implications of its jurisprudence for both the member states and the future of European human rights law.
