Анотація (abstract)

This article examines the complex interplay between individual autonomy and collective well-being within the legal and ethical frameworks surrounding mandatory vaccination policies. The focus is on Article 8 of the European Convention on Human Rights (ECHR), which ensures the right to private and family life. Utilizing an interdisciplinary methodology, the paper scrutinizes key legal cases, including M. A. K. and R. K. v. The United Kingdom (2010), Solomakhin v. Ukraine (2012), and Vavři ka and others v. the Czech Republic (2021), to elucidate the jurisprudential principles that should govern obligatory medical interventions. The research also incorporates the ethical dimensions of informed consent and other normative guidelines, such as the Nuremberg Code. The paper argues that while states have the prerogative to enact public health measures like mandatory vaccination, such interventions must align with a robust legal infrastructure that respects individual liberties and adheres to international human rights norms. Recommendations for policy development and areas for future academic research are delineated.
